Both State and Federal law govern how much can be garnished in New Jersey. Under Federal Law, a judgment creditor may only garnish the lesser of twenty-five (25%) of your disposable earnings. (Disposable income is the net amount after mandatory deductions such as taxes and social security).
In addition, in New Jersey a creditor may only garnish up to ten (10%) of your wages, provided you earn no more than two hundred and fifty percent (250%) of the Federal Poverty Level as set by the Federal Government.
At present the Federal Poverty Level is $15,060.00.
Military pay and military benefits are always exempt from garnishment in New Jersey.
